Judy A. (Fowler) Byrne
Judy Byrne is a litigation partner in the Waterloo and Guelph offices of Miller Thomson in southwest Ontario. With over twenty years of experience, she specializes primarily in estate litigation, family law, and commercial litigation matters. Judy has successfully argued matters before the Superior Court of Justice, the Ontario Court of Appeal, the Ontario Court of Justice, the Federal Court of Canada and the Federal Court of Appeal.
In the area of estate litigation, Judy can assist with will challenges, capacity issues, dependant support claims, unjust enrichment and constructive trust claims, trust disputes, passing of accounts, guardianship applications and power of attorney disputes.
In the area of family law, Judy can assist with the issues associated with separation, either through the end of a marriage or a common law relationship. She has experience with the division of complex family businesses, family trusts, and has particular experience with the interplay between family law and estate issues, and family law and bankruptcy issues. Judy can assist you in resolving these issues through mediation, a separation agreement, or will bring the matter to trial, if necessary. Judy can also assist in custody and access disputes, both domestic and international. She can assist in preventing many of these issues through the use of a marriage or cohabitation agreement.
Judy also has experience in a vast number of commercial litigation matters such as contract disputes, shareholder disputes, securities litigation, construction matters, tax law and intellectual property litigation.
Judy is a member of the Advocates Society, the Waterloo Law Association and Wellington Law Association.
