Adina Georgescu, a lawyer specializing in administrative law, municipal and urban planning law, environmental law and energy law, gives a training session on the conservation of natural environments and expropriation at the Conseil Patronal de l’Environnement (CPEQ). She is accompanied by Mr. Steve Larose, urb. president and CEO of Logha and Anthony-Charles Albert, chartered appraiser with the firm Gauthier Roy Huot.

She will present the legal aspects of the legislation, and Mr. Larose will explain the practical considerations from an urban planning point of view.

The training session will present the new rules recently adopted for expropriation, with a particular focus on the conservation of natural environments. More specifically, the following topics will be covered:

  • An Act to amend the Act respecting municipal taxation and other legislative provisions (2023, chapter 33) (Bill 39):
    • Justified infringements of property rights, allowing dispossession without compensation, for the purposes of:
      • protection of wetlands and watercourses
      • preservation of ecologically significant environments
      • health, safety or protection of property
    • Unjustified infringement of property rights
  • An Act respecting expropriation (Bill 22):
    • New rules for determining expropriation compensation
