PITFALLS TO AVOID IN THE ACQUISITION, RENTING OF PROPERTIES, AND ENVIRONMENTAL STANDARDS TO BE MET IN REAL ESTATE
(Adina Georgescu and Steven Chaimberg)
PART 1: The presentation will offer an in-depth analysis of real estate leasing, highlighting crucial aspects such as the prerequisites to the lease offer, its binding nature or not, and the various clauses that require special attention during negotiations between parties
PART 2: Me Joubert’s presentation will explore how the recent Blais v. Laforce and Badin v. Canada Inc. decisions confirm the principle that a clear and unequivocal exclusion of the legal warranty in a deed of sale constitutes an express waiver by the buyer of any legal warranty, preventing subsequent buyers from having recourse against any previous seller.
LAW CONCERNING EXPROPRIATION: MAJOR REFORM OF QUEBEC LAW – BILL 22
(Adina Georgescu and Roxane Nadeau)
Since 2017, several special laws have been enacted to frame major public transit infrastructure projects. These legislative measures have established a legal framework aimed at facilitating the realization of projects such as the REM, subways, and trams. However, a persistent challenge remains: the high cost of expropriation indemnities, which represents a significant portion of the budgets allocated to these projects. The presentation will explore the different principles of expropriation compensation (UMEPP and Planning Blight) currently in force, applied by Quebec courts and those that will soon be introduced in the Quebec legal landscape.
MODERNIZATION OF ENERGY TRANSITION: LEGISLATIVE AND REGULATORY FRAMEWORK
(Adina Georgescu and Roxane Nadeau)
This presentation by Mes Georgescu and Nadeau aims to provide an overview of the Quebec government’s master plan in terms of transition, innovation, and energy efficiency. Furthermore, it will aim to present the elaborate implementation through the Plan for a Green Economy 2023–2028, which will inevitably have a significant impact on the current legislative framework.
