Under the Condominium Act, 1998, no agreement to purchase a new condominium unit is complete until both a signed agreement of purchase and sale and disclosure documentation have been provided to purchasers. However, note that unless material changes (as defined in the Condominium Act, 1998) are made, you may not be notified of the changes and such updates do not extend your 10-day right of rescission period.
As of January 1, 2021, all developers of residential condominiums in Ontario are required to provide purchasers with the Ontario Residential Condominium Buyer’s Guide. You can access the most recent copy of the Guide from the Condominium Authority of Ontario website.
For purchasers of homes covered by Tarion Warranties, Tarion provides the following online tools: (1) the “Homeowner Resources and Learning Hub,” which includes interactive modules that provide overviews of specific parts of the new home buying journey and the relevant warranty information, including the substantive warranty process information that was formerly included in a document titled Homeowner Information Package; and (2) “MyHome Portal,” where your agreement of purchase and sale can be registered.
