Overview
Ben Pearson assists clients with protecting and enforcing their intellectual property rights, with a focus on the areas of intellectual property litigation and strategy. Ben is passionate about working with inventors, entrepreneurs, and innovators to understand their businesses and develop a robust intellectual property strategy.
Ben also has experience in intellectual property licensing and resolving domain disputes.
Ben has significant expertise in pharmaceutical patent litigation, having represented leading innovative drug manufacturers before the Ontario and Federal Courts. He has also represented industry-leading clients across life sciences, energy, agriculture and high-tech sectors.
Ben provides pragmatic advice and counsel in a number of areas, including:
- Intellectual Property Litigation: significant trial experience before Federal and Provincial Courts related to life sciences, energy, agriculture and high-tech sectors
- Intellectual Property Strategy and Licensing: advising publicly traded corporations on acquisition of intellectual property portfolios, drafting and negotiating joint development agreements, licensing agreements, NDAs, and purchase agreements
- Privacy Law: ensuring compliance with Personal Information Protection and Electronic Documents Act (PIPEDA) and General Data Protection Regulation (GDPR) privacy regulations
- Domain Disputes: assisting clients with bad-faith actors using confusingly similar web domains, submissions before Canadian Internet Registration Authority (CIRA)
Ben completed his law degree at the Schulich School of Law at Dalhousie University, where he was an active community member. He served as co-president of the Intellectual Property Law Association of Dalhousie and director for the nationwide student Law Games, while also taking on pro bono projects for Autism Nova Scotia. During his time at the university, he participated in an exchange program with the National Law School of India University in Bangalore.
Prior to law school, Ben completed an Honors Bachelor of Health Sciences while working for Health Canada’s Therapeutic Products Directorate. He also interned at a UK hospital with a focus on thrombolytic therapy.
In his spare time Ben enjoys leisure pursuits including photography, back-country camping, and sailing.
